An employer who is an Indian within the meaning of the federal Indian Act, that is, an individual who is registered or is entitled to be registered as an Indian with Indigenous Services Canada.

A corporation whose shareholders are Indians cannot be considered an Indian employer because a corporation is a legal person, not an individual.
