New Unclaimed Property Act

With certain exceptions, the measures of the Unclaimed Property Act took effect on June 13, 2011. The new Act prescribes rules for provisionally administering unclaimed property. Note that the Minister of Revenue was given the responsibility for provisional administration of unclaimed property on April 1, 2006.

The new Act incorporates several provisions of the Public Curator Act. However, certain changes have been made, in particular, there have been changes made to sections detailing auditing and investigative powers, certain penal provisions and certain procedural provisions related to evidence.

Note that the Regulation respecting the application of the Public Curator Act will remain in force until a new regulation related to the Unclaimed Property Act takes effect.
