Conditions for use of clicSÉQUR and the services offered by the departments and agencies using clicSÉQUR

In this document, the term "applicant" refers to an individual in business, a partnership, a corporation or other any legal entity that wishes to use clicSÉQUR and the services offered by government departments and agencies using clicSÉQUR (hereinafter referred to as "departments and agencies"), including the Clic Revenu services offered by Revenu Québec.

Note: In this document, "departments and agencies" (which refers to government departments and agencies using clicSÉQUR), can refer either to all departments and agencies or to any one of them individually.

clicSÉQUR is the Québec government's authentication service.

By registering with clicSÉQUR, applicants

  • receive a user code and password by which they can be verified through clicSÉQUR each time they wish to use the services offered by departments and agencies;
  • are automatically registered for Clic Revenu services;
  • authorize a person in charge of online services to register them with department and agency services, manage powers of attorney, view and revoke assignments of powers of attorney and use the services offered by departments and agencies.

clicSÉQUR service provider: In this document, the term "service provider" refers to Revenu Québec or any other department or agency designated by the Québec government to provide clicSÉQUR. The service provider (currently Revenu Québec)

  • verifies the identity of the applicant and, if the conditions have been satisfied, registers the applicant with clicSÉQUR. The applicant is assigned a user code and password;
  • authenticates the applicant for departments and agencies every time the applicant accesses their services;
  • sends secure email pertaining to clicSÉQUR;
  • offers technical assistance to clicSÉQUR users.

Clic Revenu is a collection of services offered by Revenu Québec (clicSÉQUR participant). These services enable those designated by the applicant to

  • conduct transactions pertaining to the applicant's tax file, including the filing of the required returns and the remittance of amounts owing etc., under laws, programs, agreements or treaties administered, applied or enforced by Revenu Québec;
  • receive secure email from Revenu Québec through Clic Revenu concerning communications to the applicant under laws, programs, agreements or treaties administered, applied or enforced by Revenu Québec;
  • view certain data contained in the applicant's tax file.

Role of the applicant (or authorized representative) 

Applicants may appoint an authorized representative to act on their behalf. Such authorization may arise from the person's position in the company, or may be granted by the applicant.

In certain cases, the applicant or the applicant's authorized representative must sign the registration form and submit it as a paper document to the service provider. He or she must also designate one or more persons to be in charge of online services, sign the power of attorney forms by which such designations are made, and submit the forms (as paper documents) to the service provider.

Responsibilities of the applicant

Online transactions conducted by means of a user code and password have all the legal effect of transactions carried out in accordance with instructions given in writing and signed by the applicant.

The applicant is responsible at all times for the accuracy of the data and information provided by means of clicSÉCUR or department and agency services. The applicant undertakes to inform the service provider of any changes that affect the information appearing on the registration form.

The applicant undertakes to inform the service provider if a new person is appointed as authorized representative.

The applicant is responsible for monitoring and updating powers of attorney granted to the persons in charge of online services.

The applicant must also inform the persons in charge of online services and the users of those services of their obligations under the conditions for use, for example, those concerning confidentiality of the user code and password, security, etc.

Roles and responsibilities of the person in charge of online services

The person in charge of online services acts as the applicant's representative with the service provider and departments and agencies in all transactions concerning the applicant, including the communication of confidential information. This person has access to all of the applicant's services and files, both current and future (including those that are amended).

The person in charge of online services may register the applicant with department and agency services and have access to these services under the stated conditions.

The person in charge of online services may extend access to clicSÉQUR and department and agency services to other persons (hereinafter referred to as users). This person may also authorize the service provider or departments and agencies to disclose confidential information to the users, in which case the service provider must assign each user a user code and password providing them access to these services. These codes and passwords are considered to have been assigned to the applicant.

The person in charge of online services has complete authority to control user access, in particular, to determine, suspend, reactivate, modify or revoke a user's access rights. However, the person in charge can only suspend or reactivate the access of another person in charge.

The person in charge may cancel the applicant's registration with clicSÉQUR or department and agency services. This person may also request reactivation of the applicant's registration with clicSÉQUR or department and agency services. In such cases, the decision passes to the service provider or the departments or agencies.

User codes and passwords

During an online clicSÉQUR registration session, the authorized representative will be assigned a user code and temporary password by the service provider for each person in charge of online services. These codes and passwords are considered to have been assigned to the applicant.

The user codes are activated at the same time as a registration file that is activated directly online. However, if certain registration information needs to be validated, the user codes are activated only after this has been done.

Furthermore, if registering requires documents to be signed, the codes are activated only after the service provider has received paper copies of the registration form and any other required documents. All other conditions must also have been met.

The person in charge of online services must change their password at first use, and will then be able to obtain the codes and passwords for the users.

Confidentiality: User code and password

The applicant is responsible for all actions that involve the use of a user code and password, unless the applicant has informed the service provider of their unauthorized use.

Users must keep their codes and passwords confidential, and must not disclose them to or allow them to be used by a third party. They must also change their password periodically for security reasons.

Users must immediately report to the person in charge of online services any unauthorized use of a user code or password, or any attempted breach of access security. Users must employ all the means at their disposal to use the services under conditions of optimum security.

Persons in charge of online services must immediately report to the service provider any unauthorized use of a user code or password, or any attempted breach of access security. These persons must employ all the means at their disposal to use the service under conditions of optimum security.

Neither the service provider, the departments and agencies nor the Québec government can be held responsible for loss or damage resulting from a failure to fulfil the obligations mentioned in this section.

Changes in conditions for use

Conditions for use of clicSÉQUR can be found on the service provider and department and agency websites. Applicants agree to consult these sites periodically for updated information.

The service provider or departments and agencies may modify the conditions for use of clicSÉQUR (for their respective services) at any time, without prior notice, provided they post the new conditions on their websites.

By continuing to use clicSÉQUR and department and agency services, applicants indicate that they accept the changes made to these services.

Access to services

Access to clicSÉQUR and department and agency services is not subject to a time limit.

The service provider can suspend or revoke access to clicSÉQUR services, without advance notice to the applicant. Access to clicSÉQUR may therefore be denied at any time, as when there is reason to believe that requirements have not been met or a law has been violated. The service provider can also suspend or revoke access if the service remains unused for too long. The same is true for departments and agencies with regard to their respective services.

The service provider or departments and agencies may cancel access to their respective services where an event (bankruptcy, liquidation, dissolution, owner's death, etc.) changes the conditions under which the business was registered.

Applicants may cancel their access to clicSÉQUR or department or agency services at any time.

Applicants authorize the service provider to inform departments and agencies that their access to clicSÉQUR has been suspended at their request or that of the service provider.

Data preservation

All transaction data is stored by the service provider or departments and agencies in their databanks and constitute the proof of the transaction in the same way a paper copy would. The data include a record of each time clicSÉQUR or department and agency services are accessed using a user code and password.

Confidentiality of information

The service provider and departments and agencies protect the confidentiality of the data transmitted, and maintain security measures in accordance with their legal obligations in this area.

Communication with the applicant

The service provider provides a secure mail box on its website for each person with a user code and places in this box messages for the applicant concerning clicSÉQUR.

Departments and agencies can also use this mail box to transmit messages about their services.

The applicant agrees that the service provider or departments and agencies will place communications in the secure mail box that is assigned to each user and that the mail box is the user's active address.

Availability of services

The service provider reserves the right to change or interrupt all or a portion of a clicSÉQUR service temporarily without advance notice to the applicant. The service provider reserves the right to change or interrupt all or a portion of such a service permanently after giving advance notice to the applicant. The same is true for departments and agencies with regard to their respective services.

Links to other Websites

The service provider and department and agency websites sometimes provide links to other sites. This access does not mean that the service provider or departments and agencies approve the contents of the sites or any connecting sites (relating to products, services or equipment, for example).

Commercial software

clicSÉQUR or some department and agency services may be accessible through commercial software. However, the service provider, the departments and agencies and the Québec government do not guarantee access to clicSÉQUR or department and agency services through such software, or the operation or effectiveness of services accessed in this way. They may suspend or terminate such access at any time.

Applicable legislation

Any dispute that may arise regarding an application for registration, the conditions for use, clicSÉQUR or department and agency services is governed by Québec legislation. The applicant acknowledges the jurisdiction and exclusive competence of the courts of Québec in this respect.
